1. Data We Collect

We may collect the information necessary to operate KAYF and provide its services, including:

• Name and contact information.
• Account registration and login information.
• Mobile number, and the one-time code sent to it by SMS or WhatsApp to confirm the number and sign in.
• Order and transaction information.
• App usage data: the screens opened, what is searched for inside the application, and what is added to the basket — used to improve the application and to rank suggestions.
• Location data when the user permits the application to access their location.
• Payment information necessary to complete a transaction through the payment provider.
• Communications, inquiries, and complaints submitted by the user.
• An identifier of the application’s own installation on the device, kept only as an irreversible digest. It is used solely to limit abuse of offers and to prevent fraud; it is not used for advertising, is not linked to any advertising identifier, and is not shared with any third party.

We do not request or collect more data than is necessary for the purposes for which it is collected.

2. Use of Data

We use personal data for the following purposes:

• Creating and managing the user’s account.
• Processing and fulfilling orders.
• Connecting the order with the selected merchant.
• Processing payments.
• Sending order updates and notifications.
• Providing customer service and handling complaints.
• Improving the performance and security of KAYF.
• Preventing fraud and unlawful use.
• Complying with legal and regulatory obligations.

3. Legal Basis for Processing

Personal data is processed in accordance with purposes and legal grounds permitted by applicable law, including the performance of a contract or taking steps at the user’s request prior to entering into a contract, compliance with legal obligations, legitimate interests where applicable, or the user’s consent where consent is legally required.

Personal data will not be used for a new purpose that is incompatible with the purpose for which it was collected, except as permitted by law.

4. Sharing of Data

We may share the data necessary to provide the service with:

• The merchant selected by the user to fulfill the order.
• Electronic payment service providers.
• Technical and operational service providers working on behalf of KAYF.
• Competent authorities where disclosure is required by law.

We do not sell users’ personal data.

Service providers engaged by KAYF are required to comply with applicable legal and technical data protection requirements according to the nature of their services.

5. Transfer of Data Outside the Kingdom of Bahrain

Some data may be processed or stored through service providers located outside the Kingdom of Bahrain.

Where personal data is transferred outside the Kingdom, such transfer shall be carried out in accordance with the requirements and controls prescribed under the Personal Data Protection Law and regulations governing the transfer of personal data outside the Kingdom.

6. Geolocation

KAYF may request permission to access the user’s location in order to display nearby merchants or provide location-based services.

The user may control location permissions through their device settings.

7. Data Protection

Dar Alkayf applies appropriate technical and organizational measures to protect personal data against loss, destruction, alteration, unauthorized disclosure, or unauthorized access, in accordance with applicable legal and technical requirements.

8. Data Retention

We retain personal data only for as long as necessary to fulfill the purpose for which it was collected, or for the period required by law or necessary to protect the legal rights and interests of the platform and its users.

When the data is no longer required, it will be deleted, anonymized, or otherwise handled in accordance with applicable legal requirements.

9. User Rights

In accordance with applicable law, users may request to exercise their rights relating to their personal data, including rights relating to access, correction, deletion, or other rights granted by law, subject to applicable legal conditions and exceptions.

10. Account Deletion

Users may request the deletion of their account and personal data through the means provided by KAYF.

The platform may retain certain data where retention is required by law or necessary to evidence transactions or protect legal rights.

11. Account Security

Users are responsible for maintaining the confidentiality of their login credentials and must notify KAYF immediately if they suspect unauthorized use of their account.

12. Smart Personalisation

To offer each user a more suitable experience, KAYF may use the user’s own usage of the platform — completed orders and their times, when the app is opened, the cafés ordered from, the answers chosen in “What’s your mood today?”, ratings, and what the user entered in their own profile (name, date of birth, gender) — in order to:

• Rank suggestions and drinks to suit the user’s taste and time of day.
• Greet the user on their personal occasions within the application.

These inferences are computed within KAYF’s systems and used automatically only; they are not shown to the user or to anyone as a profile of them, and are not shared with cafés or with any third party for marketing purposes.

The user may switch smart personalisation off at any time from the “My Account” page using the “Smart personalisation” switch, after which these inferences are not used in what the application shows them.

13. Updates to This Policy

This Privacy Policy may be updated when necessary. The updated version will be published within the application or website and will take effect from the date of publication unless otherwise required by law.

قد نجمع البيانات اللازمة لتشغيل KAYF وتقديم خدماتها، ومنها:

• الاسم وبيانات التواصل.
• بيانات إنشاء الحساب وتسجيل الدخول.
• رقم الهاتف المحمول، ورمز التحقق المُرسل إليه برسالة نصية أو عبر واتساب لتأكيد الرقم وتسجيل الدخول.
• بيانات الطلبات والمعاملات.
• بيانات استخدام التطبيق: الصفحات التي تُفتح، وما يُبحث عنه داخل التطبيق، وما يُضاف إلى السلة — لتحسين التطبيق وترتيب الاقتراحات.
• بيانات الموقع عند السماح للتطبيق باستخدام الموقع.
• بيانات الدفع اللازمة لإتمام المعاملة من خلال مزود الدفع.
• المراسلات والاستفسارات والشكاوى التي يقدمها المستخدم.
• معرّف خاص بنسخة التطبيق على الجهاز، يُحفظ بصيغة مشفّرة لا يمكن إرجاعها، ويُستخدم فقط للحدّ من إساءة استخدام العروض ومنع الاحتيال؛ ولا يُستخدم للإعلانات ولا يُربط بأي معرّف إعلاني ولا يُشارك مع أي طرف ثالث.

لا نطلب أو نجمع بيانات أكثر مما يلزم للأغراض التي يتم جمعها من أجلها.

2. استخدام البيانات

نستخدم البيانات الشخصية من أجل:

• إنشاء وإدارة حساب المستخدم.
• تنفيذ الطلبات ومعالجتها.
• ربط الطلب بالمنشأة المختارة.
• معالجة عمليات الدفع.
• إرسال تحديثات وإشعارات الطلب.
• تقديم خدمة العملاء ومعالجة الشكاوى.
• تحسين أداء وأمان KAYF.
• منع الاحتيال والاستخدام غير المشروع.
• الوفاء بالالتزامات القانونية والتنظيمية.

3. الأساس القانوني للمعالجة

تتم معالجة البيانات وفقاً للأغراض والأسس المسموح بها قانوناً، بما في ذلك تنفيذ العقد أو اتخاذ خطوات بناءً على طلب المستخدم لإبرامه، والالتزامات القانونية، والمصالح المشروعة متى كانت منطبقة، أو بناءً على موافقة المستخدم عندما تكون الموافقة مطلوبة.

ولا تستخدم البيانات الشخصية لغرض جديد غير متوافق مع الغرض الذي جُمعت من أجله إلا وفقاً لما يسمح به القانون.

4. مشاركة البيانات

قد نشارك البيانات اللازمة لتنفيذ الخدمة مع:

• المنشأة التي اختارها المستخدم لتنفيذ الطلب.
• مزودي خدمات الدفع الإلكتروني.
• مزودي الخدمات التقنية والتشغيلية الذين يعملون لصالح KAYF.
• الجهات المختصة عندما يكون الإفصاح مطلوباً بموجب القانون.

لا نقوم ببيع البيانات الشخصية للمستخدمين.

ويلتزم مزودو الخدمات الذين تتم الاستعانة بهم بالمتطلبات القانونية والفنية المتعلقة بحماية البيانات بحسب طبيعة خدماتهم.

5. نقل البيانات خارج مملكة البحرين

قد تتم معالجة أو تخزين بعض البيانات من خلال مزودي خدمات موجودين خارج مملكة البحرين.

وعند إجراء نقل للبيانات الشخصية خارج المملكة، يتم ذلك وفق المتطلبات والضوابط المقررة بموجب قانون حماية البيانات الشخصية والقرارات المنظمة لنقل البيانات الشخصية خارج المملكة.

6. الموقع الجغرافي

قد يطلب KAYF إذن الوصول إلى موقع المستخدم لعرض المنشآت القريبة أو تقديم الخدمات التي تعتمد على الموقع.

يمكن للمستخدم التحكم في إذن الموقع من إعدادات جهازه.

7. حماية البيانات

تلتزم دار الكيف بتطبيق التدابير الفنية والتنظيمية المناسبة لحماية البيانات الشخصية من الفقد أو الإتلاف أو التغيير أو الإفصاح أو الوصول غير المصرح به، وفقاً للمتطلبات القانونية والفنية المعمول بها.

8. مدة الاحتفاظ بالبيانات

نحتفظ بالبيانات الشخصية فقط للمدة اللازمة لتحقيق الغرض الذي جُمعت من أجله، أو للمدة التي يتطلبها القانون أو لحماية الحقوق والمصالح القانونية للمنصة والمستخدمين.

وعند انتهاء الحاجة إلى البيانات، يتم حذفها أو إخفاء هويتها أو التعامل معها وفق المتطلبات القانونية.

9. حقوق المستخدم

وفقاً للقانون، يجوز للمستخدم طلب ممارسة حقوقه المتعلقة ببياناته الشخصية، بما في ذلك الحقوق المتعلقة بالاطلاع أو التصحيح أو الحذف أو غيرها من الحقوق المقررة قانوناً، وفق الشروط والاستثناءات القانونية.

10. حذف الحساب

يمكن للمستخدم طلب حذف حسابه وبياناته الشخصية من خلال الوسائل التي توفرها KAYF.

وقد تحتفظ المنصة ببعض البيانات التي يلزم الاحتفاظ بها بموجب القانون أو اللازمة لإثبات المعاملات أو حماية الحقوق القانونية.

11. أمن الحساب

يتحمل المستخدم مسؤولية المحافظة على سرية بيانات الدخول الخاصة به، ويجب عليه إبلاغ KAYF فوراً عند الاشتباه في استخدام غير مصرح به لحسابه.

12. التخصيص الذكي

لتقديم تجربة أنسب لكل مستخدم، قد يستخدم KAYF بيانات استخدام المستخدم للمنصة — طلباته المكتملة وأوقاتها، أوقات فتح التطبيق، المقاهي التي يطلب منها، ما يختاره في «كيفك اليوم؟»، تقييماته، وما أدخله بنفسه في ملفه الشخصي (الاسم، تاريخ الميلاد، الجنس) — من أجل:

• ترتيب الاقتراحات والمشروبات بما يناسب ذوق المستخدم ووقته.
• تهنئة المستخدم بمناسباته الشخصية داخل التطبيق.

تُحسب هذه الاستنتاجات داخل أنظمة KAYF وتُستخدم آليًا فقط؛ فلا تُعرض على المستخدم ولا على أي شخص ملفًا عنه، ولا تُشارك مع المقاهي أو مع أي طرف ثالث لأغراض تسويقية.

يستطيع المستخدم إيقاف التخصيص الذكي في أي وقت من صفحة «حسابي» عبر مفتاح «التخصيص الذكي»، وعندها لا تُستخدم هذه الاستنتاجات في ما يعرضه التطبيق له.

13. تحديث السياسة

يجوز تحديث سياسة الخصوصية عند الحاجة. ويتم نشر النسخة المحدثة داخل التطبيق أو الموقع، ويُعمل بها من تاريخ نشرها ما لم يتطلب القانون خلاف ذلك.
